1. Acceptance of Terms

By providing your phone number and opting into our SMS service, you acknowledge and agree‬ to these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these‬ Terms, you should not use the Service.

5. Service Availability

We make reasonable efforts to provide uninterrupted SMS services, but we do not guarantee‬ that the service will be available at all times. The service may be subject to disruptions or‬ outages beyond our control, including those caused by technical issues with mobile networks or‬ telecommunications providers.‬

6. No Warranty

‬‭ Our SMS service is provided “as is” without any warranties of any kind, either express or‬‭ implied. We do not guarantee the accuracy, reliability, or timeliness of the messages delivered‬‭ via SMS. You agree to use the service at your own risk.‬

7. Limitation of Liability‬

To the fullest extent permitted by law, Pamlico Solar LLC, its affiliates, and its service providers‬ ‭shall not be liable for any direct, indirect, incidental, special, or consequential damages arising‬ from your use of the SMS service, including but not limited to damages related to:‬

  • ‬‭ Any loss or damage caused by unauthorized access to your mobile device or account.‬
  • ‬‭ Delays or failures in the transmission of SMS messages.‬
  • ‬‭ Any errors, bugs, or interruptions in the service.

You agree that your sole remedy for any dissatisfaction with the SMS service is to discontinue‬ using the service.‬

8. Changes to the Service and Terms

We reserve the right to modify or discontinue our SMS service at any time, with or without‬ notice. We may also update or change these Terms and Conditions from time to time. Any‬ changes will be posted on our website or communicated to you via SMS. Your continued use of‬ the SMS service after any changes to these Terms will constitute your acceptance of those‬ changes.‬

These Terms and Conditions are governed by the laws of the State of North Carolina, United‬ States without regard to its conflict of law principles. Any disputes arising from these Terms will‬ be resolved in the courts located in New Hanover County.‬

12. Indemnification‬

You agree to indemnify, defend, and hold harmless Pamlico Solar LLC, its affiliates, directors,‬ officers, employees, and agents from and against any claims, liabilities, damages, losses, and‬ expenses (including legal fees) arising from your use of the SMS service or your violation of‬ these Terms and Conditions.‬

13. Severability‬

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.‬
